How to Comply With New Stark Rules
For hospitals, physicians and other health care providers

On March 26, CMS published the long-awaited second set of regulations under the physician self-referral law, known as Stark II Law. These rules govern business relationships between referring physicians and the entities with which they have financial relationships. The first set of Stark II regulations were issued in January 2001, with CMS indicating the second set would be issued "shortly." Three years later, hospitals, physicians and other health care providers finally have the second piece of the puzzle needed to implement these complex provisions.

During this audioconference, two highly skilled veterans of Stark implementation help you thrash through this regulatory jungle by:

  • Highlighting the major new Phase II provisions and
  • Underscoring the serious pitfalls and new opportunities ahead for hospitals and other health care providers, and their referring physicians.

You'll benefit from a highly practical 60-minute program that is structured as follows:

  • Brief Overview of Stark Law
  • Significant Provisions of the New Phase II Regulations
    • Exceptions for ownership interests (e.g., joint ventures) and compensation arrangements between entities and physicians (e.g., employment, physician recruitment, personal service arrangements)
    • Exception for services furnished in an ambulatory surgical center, end-stage renal disease dialysis facility or hospice
    • Comments received in response to Phase I
    • New exceptions
    • Reporting requirements
    • Sanctions
  • Practical Advice for Hospitals, Physicians and Other Providers
